These Terms of Sale govern all purchase contracts concluded between Sivoren and our customers. By placing an order on our website, you acknowledge that you have read, understood and accept all terms set out below, together with our Shipping Policy, Return & Refund Policy, Legal Disclaimer and Privacy Policy. These terms comply with French commercial law and the EU Consumer Rights Directive.

1. Parties & Contract Formation

1.1 The seller is Sivoren, with the address and contact details listed above. The buyer is the individual or entity submitting an order on our website. 1.2 When you submit an order and complete payment, you are submitting an offer to purchase goods. Your order is only accepted, and a binding sales contract is formed, once Sivoren sends you an order confirmation email. 1.3 Sivoren reserves the right to refuse or cancel any order at our sole discretion, including but not limited to cases of suspected fraud, incorrect pricing, product out-of-stock, invalid shipping address or violation of these terms. We will fully refund any cancelled paid orders.

2. Product Information & Pricing

2.1 Product descriptions, photos, sizes and specifications are provided for reference. Minor visual differences due to screen settings, lighting and manufacturing batch variations are not considered product defects. 2.2 All prices displayed on the website are in Euro (EUR), inclusive of French VAT for orders within Metropolitan France. For shipments to other EU countries or outside the EU, additional local VAT, customs duties or import taxes may apply and shall be borne by the customer. 2.3 Shipping fees are calculated separately and displayed at checkout. 2.4 Sivoren reserves the right to modify product prices and promotional offers at any time. Price changes will not affect orders that have already been confirmed. In case of obvious technical price errors, we have the right to cancel the order and refund the full payment.

3. Payment Terms

3.1 We accept payment methods displayed on the checkout page. Payment must be fully completed before order processing begins. 3.2 You warrant that you are the lawful holder of the payment method used and that all payment details you provide are true and valid. 3.3 If payment is rejected, declined or disputed without valid grounds, Sivoren reserves the right to suspend delivery, cancel the order and claim compensation for any losses incurred.

4. Order Fulfilment & Delivery

4.4 Order processing and delivery shall follow our published Shipping Policy. Estimated delivery times are estimates only and not guaranteed. 4.5 It is the customer’s responsibility to provide a complete and accurate delivery address. We are not responsible for failed delivery caused by wrong or incomplete address information provided by the buyer. 4.6 Ownership of the goods transfers to the customer only after full payment has been received and the parcel has been successfully delivered to the recipient. Risk of loss or damage to the goods passes to the customer upon handover of the package to the logistics carrier.

5. Right of Withdrawal & Returns

5.1 For EU consumers, you have a statutory 14-day cooling-off period to withdraw from the contract without giving reasons, starting from the day you receive the goods. 5.2 To exercise the withdrawal right, you must notify us by email within the 14-day period. You shall return the goods at your own cost, in original condition and original packaging. 5.3 Exclusions to the withdrawal right apply for custom-made goods, sealed items that have been opened for hygiene reasons, digital products or perishable goods, in accordance with EU consumer law. 5.4 Refunds will be processed after we receive and inspect the returned goods. Original shipping cost may be deducted according to our Return & Refund Policy.

6. Product Warranty

6.5 Our products come with a statutory warranty in compliance with French consumer law, covering manufacturing defects. 6.6 The warranty does not cover damage caused by improper use, accidental impact, unauthorized modification, normal wear and tear, incorrect installation or failure to follow product instructions. 6.7 If you receive defective goods, please contact us within the time frame specified in our Shipping Policy and provide required evidence such as photos. We will arrange remedy by repair, replacement or refund at our discretion.

7. Intellectual Property

All trademarks, texts, images, graphics and designs on the website belong to Sivoren. You may not copy, reproduce or use any of our intellectual property for commercial purposes without prior written consent.

8. Limitation of Liability

Subject to mandatory provisions of French and EU law, Sivoren shall not be liable for indirect, consequential, incidental or economic loss including loss of profit, loss of use, business interruption arising from the goods. Nothing in these terms limits liability for death, personal injury caused by negligence, fraud or mandatory statutory rights of consumers.

9. Force Majeure

Sivoren shall not be liable for any delay or failure to perform obligations caused by events beyond our reasonable control, including natural disasters, pandemic, carrier strikes, customs delays, government restrictions and other force majeure events. We will notify customers as soon as reasonably possible and suspend order performance until the event ends.

10. Dispute Resolution & Governing Law

These Terms of Sale are governed by the laws of France. Any disputes shall first be resolved by friendly negotiation. If negotiation fails, disputes shall be submitted to the competent courts in France. EU consumers may also use the European Online Dispute Resolution platform for out-of-court dispute settlement.

11. Amendment of Terms

Sivoren reserves the right to update these Terms of Sale. Updated terms will be published on the website. Changes do not apply to orders confirmed before the update date.
